The Jharkhand State Information Commission has imposed a fine of Rs75,000 on VBU administration. The court of Information Commissioner Himanshu Shekhar Choudhary gave the judgment on Thursday after hearing appeal number 1693/14 dated 07.01.16 that the Information Officer of VBU tried to mislead both the commission and applicant. Under Section 20(1) he has imposed a fine of Rs25000 on PIO VBU and under Section 20(2) has directed the Vice Chancellor to initiate proceedings against him. The court has also ordered to pay Rs50,000 to the applicant as a compensation for harassing him under Section 19(9)(B) of RTI Act.
The matter is related with the irregularities in appointment of B.Ed teachers. The matter is related with Chatra College where more than two years ago Veena Kumari was posted as a B.Ed teacher by VBU administration on contractual basis.
Someone complained that Veena Kumari is not a resident of Jharkhand so she is not entitled to get the benefits of reservation here. The matter was suppressed that time after transferring Veena Kumari to JJ College, Koderma. Then the complainant used RTI to get the copy of certificates of Veena Kumari. Since the appointments were made by university headquarter so he gave application to PIO of VBU.
VBU administration gave him incomplete information then he made the first appeal. But here to he got only dates. Then he moved to State Information Commission. VBU administration first informed to commission that the copies of her residential and caste certificate had been given to the applicant but later refused and said that it is not available in the office. On 7th January the advocate of VBU argued that by mistake the VBU administration had written residential certificate in its reply and only caste certificate was given to the applicant. The court cancelled his argument and gave a hard hitting judgment.
Now VBU administration is preparing to go to High Court against this decision but it has no answer of a simple question which is arising in this whole issue that when Veena Kumari is still working in a college under your jurisdiction then why not the administration has yet demanded her residential certificateIJ
These days VBU administration is in trouble due to the new appointments made for B.Ed courses. On 9th January it had published the list of newly appointed B.Ed teachers and when protest started formed a committee to enquire the matter. On 24th January it again published a list in which name of Veena Kumari is included at number 6 of social science B.Ed teachers.
The commission gave its judgment on 7th January and the notification issued on 24th January in which her name is included clearly hints that the VBU administration is not interested in making a proper probe of this matter.
