The CID team, investigating former Minister Yogendra Sao’s links with the two criminal groups — Jharkhand Bachao Aandolan and Jharkhand Tiger Group — on Saturday asserted that the latter was the kingpin of both the outfits.
The investigating agency’s assertion came in a report, submitted to the court, based on the confessional statement of Sao’s brother Dhirendra Sao under Section 161 of CrPC.
However, according to a legal expert, a statement under Section 161 CrPC is not a substantive piece of evidence. “The said statement can be used only for the limited purpose of contradicting a witness,” he said.
Dhirendra had been taken on remand by the CID yesterday. The investigating team produced him in the SDJM court from where he was sent back to JPN central jail.
The court had given the CID team three days remand of Dhirendra but the police today said that his interrogation is now complete.
According to sources, CID ASP Anuranjan Kispotta, inspector AK Dwivedi and other three officers interrogated Dhirendra at Muffassil PS. Initially, he tried to duck the questions, but he began to spill the beans when the call details of his mobile number were shown to him.
Dhirendra was the first accused who had surrendered in this case and was the first to be taken on remand by the CID team. Sources said that the CID team posed 30 questions to Dhirendra. The questions where framed on the basis of confessional statement of Rajkumar Gupta, the supremo of Jharkhand Tiger Force.
In his statement before CID team Dhirendra has accepted that both Jharkhand Bachao Aandolan and Jharkhand Tiger Group were formed by his brother Yogendra Sao. The main work of both the organizations was to create panic in the area, collect levy and to crush the political opponents. “Yogendra Sao had provided arms and ammunitions and other items to the members of these organizations,” Dhirendra is said to have told the CID.
In his statement, Dhirendra has actually confirmed the statement given by Rajkumar Gupta earlier in the court under Section 164. He had also confirmed that Raju Sao had given training to the members of the organizations.
After this development speculations are rife that the CID team will pray for the remand of MlA Yogendra Sao on Monday. On the other hand, some are suspecting foul play in taking remand of Dhirendra Sao first and then producing him in court within 24 hours against the remand of 72 hours with his recorded statement.
