National Human Rights Commission (NHRC) has issued a ‘final’ show-cause notice to the Government in ‘proved’ misbehavior case of the then Hazaribagh Deputy Commissioner (DC) with NTPC DGM Rakesh Nandan Sahay last year.
The fresh notice by the Commission read, “These proceedings shall be read in continuation of the earlier proceedings of the Commission dated 22.01.2016 pertaining to alleged physical assault, torture and harassment of the complainant, who is a senior level officer in NTPC a Public Sector Undertaking, by an IAS Officer of Hazaribagh (Jharkhand).”
“Having considered the reports the Commission vide proceedings dated 2.6.2016 directed as under:- "Issue notice under Section 18(a)(i) of the PHR Act, 1993 to the Chief Secretary, Government of Jharkhand directing him to show cause within four weeks as to why compensation may not be recommended to be paid to the complainant for violation of his human rights because of discourteous and unseemly behaviour of Dy. Commissioner, Hazaribagh,” the Commission has stated.
It further added, “The Commission has given Jharkhand Government four week’s time to explain as to Issue a reminder to the Chief Secretary, Govt. of Jharkhand impressing upon him to send within four weeks reply to the notice issued u/s 18 PHR Act 1993 failing which the Commission may assume that the Govt. of Jharkhand has no view in the matter and it will make appropriate recommendation for payment of compensation to the complainant Rakesh Nandan Sahay.”
Commission said in notice that the DGP, Jharkhand has not submitted any report as regards the status of the investigation in the criminal cases registered in the matter. It also directed the government to “Issue a reminder to DGP, Jharkhand directing him to submit a called for report within two weeks failing which the Commission will be constrained to issue coercive process under Section 13 of the PHR Act, 1993.” Sahay was allegedly assaulted by Hazaribagh DC last year.
