Former Bihar Chief Minister and RJD chief lalu Prasad again appeared before Special CBI Courts here in connection with fodder scam cases and produced a list of 36 witnesses in RC68A/96.
“Defense witnesses were examined in two of the fodder scam cases – RC64A/96 and RC68A/96 while prosecution witnesses are being examined in RC47A/96 on day to day basis,” said lalu’s advocate Prabhat Kumar. A list of 36 witnesses has been produced in RC68A/96 from defense side, he added.
The advocate said that two of the witnesses-- retired Under Secretary of Bihar Vidhan Sabha Md Januel and the then Cabinet Minister and sitting MP Jaiprakash Narayan Yadav--were examined by the defense in RC64A/96 in the court of Special CBI Judge Shivpal Singh.
“Md. Januel was asked questions related to the proceedings of Bihar Vidhan Sabha like how questions are asked and how their reply comes in the Assembly; whether all the questions are replied or they are scrutinized before preparing a reply for themIJ” said Kumar. Januel said that everything related to the scrutiny of questions, which are to be taken and which are to be rejected, are given under Sections 76-96 of Bihar Vidhan Sabha manual, he added.
Januel also made the court aware about all other facts related to Bihar Vidhan Sabha Manual, he added.
Yadav, who was Education Minister in the State Government at that time, cleared that the sanction order given by the Governor at that time was never approved by the Cabinet and hence it was unconstitutional, said the advocate.
lalu also appeared in another fodder scam case RC47A/96, related to illegal withdrawal of Rs 139 crore from Doranda Treasury.
RC64A/96 is related to illegal withdrawal of Rs 90 lakh from Deoghar Treasury while RC68A/96 is related to illegal withdrawal of Rs 37 crore from Chaibasa Treasury.
“Go-Airways staff Gunjan and Mukhia Ramprit are to be examined on Friday,” said the Advocate.
The advocate further said that lalu will appear in all the four case on Friday and Saturday during which other witnesses, summoned by the court, will be examined in RC64A/96 and RC68A/96.
The RJDIJchief has already been convicted and sentenced to five-year imprisonment in one of the five cases and is currently on bail. The Rs 900-crore fodder scam surfaced in the early 1990s when he was the Chief Minister of Bihar.
