Allowing the petition filed by Bihar BJP leader Giriraj Singh, accused of making inflammatory speeches during his campaign trails, Jharkhand High Court on Friday quashed the warrant of arrest issued by the court of Sub-Judicial Magistrate Amit Shekher in Bokaro on April 23.

Singh is facing charges under IPC Sections 153 A, 295 A and 298 for his alleged remarks that people who do not vote for Narendra Modi will have to find a place in Pakistan.

“The warrant of arrest against him has been quashed by the court of Justice RR Prasad observing that the warrant was illegal and against Section 73 of CrPC,” said Giriraj’s Counsel Rajiv Ranjan.

According to Ranjan, there was no ground for evading warrant of arrest as he is not running away from the law.

Moreover, standard procedure for obtaining the warrant of arrest was not followed by the police.

Former Bihar minister and BJP leader moved the court following rejection of his anticipatory bail petition by Bokaro District and Sessions Court.

FIR has also been lodged against Singh by Deoghar SDO on the same grounds.

The Deoghar  district and sessions court stayed the arrest of Singh till May 3. Singh secured an anticipatory bail on April 25 by Patna District and Sessions Judge Birendra Kumar.
