The double Bench of Chief Justice of Jharkhand High Court, Justice Dr Raviranjan and Justice Sujit Narayan Prasad, on Thursday said that the CBI should deeply investigate the alleged murder case of Dhanbad Judge Uttam Anand.
The Bench pointed to the post-mortem report mentioning a one and half inch deep injury on the right side of the head of the deceased judge. It observed that such injury can’t be caused by the side mirror of the auto rickshaw.
The judge was knocked down to death by an auto rickshaw in the morning of July 28 in Dhanbad, when he was returning home after a walk.
The court said that the CBI should have submitted the forensic report of the crime site, where the accident took place. It will help to ascertain, who actually hit the judge. The court said that from the CCTV footage it seems that somebody sitting on the front seat of the auto rickshaw had hit the judge with an object.
During the virtual hearing the court expressed displeasure over the condition of the state Forensic Science laboratory where the basic facility of the pathological test of blood and urine is not available.
The matter came to light when the CBI informed the court that a forensic report could not be prepared as the State FSL returned the sample of blood and urine of the accused stating that the testing facility for the same is not available at the laboratory.
“It is shameful that the state FSL doesn’t have the basic facility of urine analysis,” the court observed.
As the next hearing of this case is scheduled on August 27, the court has directed the State Home secretary and the Director of State FSL to appear before the court on the next hearing to explain the pathetic condition of the FSL.
