BJP state spokesperson Ajay Sah reacted sharply to the statement made by Jharkhand Mukti Morcha (JMM) in support of DGP Anurag Gupta during a press conference held at the party office. He said that instead of answering the basic issues in his press conference, the JMM spokesperson only made personal jibes at Babulal Marandi. This makes it clear that JMM has also accepted the truth that Anurag Gupta's appointment as Jharkhand's DGP is completely unconstitutional.
Ajay Sah said in his press conference that the role of UPSC is important in the appointment process of DGP, as it is a constitutional body and the Supreme Court has authorized it for the DGP selection process. He stressed that appointing DGP without including a member of UPSC in the selection panel is a direct violation of the Constitution. After the Prakash Singh case, the Supreme Court had given clear instructions that the appointment of the DGP should be done only on the basis of the recommendations of the UPSC panel. He alleged that the government is talking in a roundabout way to hide this constitutional violation, whereas this is a serious matter and a transparent answer should be given on it.
Ajay Sah further said that the Central Government has full power to extend the service or increase the retirement age for appointment to the post of DGP. However, the JMM spokesperson did not give any satisfactory answer on this important issue, which makes it clear that they are only trying to mislead the public by distorting the facts.
Sah further said that recently the appointment of DGP in BJP-ruled Madhya Pradesh, Chhattisgarh and Uttarakhand has been done through the UPSC panel in accordance with the guidelines of the Supreme Court. The JMM spokesperson should study Uttar Pradesh properly. The Uttar Pradesh government has not made any such appointment of DGP by going against the rules.
Ajay Sah launched a scathing attack on the Hemant government and said that the Jharkhand government is constantly disregarding the constitutional provisions and the orders of the Supreme Court. It appears that the Hemant government is considering itself above the Constitution and the Supreme Court and is completely bypassing the legal processes in its decisions.
