Police refuse NGO's plea for FIR against Justice Ganguly

The molestation issue centering West Bengal Human Right Commission (WBHRC) chairman Justice Ashok Ganguly took curious turn with an NGO Bharat Bachao Committee on Wednesday lodging a complaint against the retired Supreme Court Judge at a local police station.

The police refused to lodge an FIR quoting Section 156/3 of the Calcutta Police rules, which says that only the victim or one’s kin could file such complaints. The police, however, said they would investigate the case and take appropriate decision in 48 hours’ time. Curiously the complaint came simultaneously with a demand from the ruling Trinamool Congress MP Derek O’Brien asking Justice Ganguly to resign as the WBHRC chief. “TMC has noted with anxiousness and concern the charges of sexual harassment against Justice Ganguly,” O’Brien said.

A law intern had written a complaint to the Supreme Court alleging sexual assault by the retired Judge who later denied charges even as the legal fraternity wondered as to why the charges were brought more than a year after the reported incident took place. Justice Ganguly had been under fire from the State Government for passing a number of orders against it on human rights violations.
