The fugitive Calcutta High Court judge Justice CS Karnan on Friday indicated through his counsel in the Supreme Court that he is ready to tender an apology before it. But, the court snubbed the counsel saying he should file his application in the registry and stop mentioning it directly before the Constitution Bench.
“I wish to file an application seeking apology. I will be arrested any moment. I am requesting to allow a hearing for my recall application,” said advocate Mathews Nedumpara, appearing for the HC judge, who has been sentenced to six-month
prison term by the SC as punishment for contempt of court.
Mentioning the matter for the second consecutive day, Nedumpara invited the ire of the Chief Justice of India JS Kehar.
The CJI said, “The seven judges who had assembled to hear the case (of Justice Karnan) have taken a conscious decision. You cannot disturb this Bench again and again. Whatever you have to file, file it before the Registry.”
Nedumpara had mentioned the matter even on Thursday and sought listing of a recall application by Karnan.
“You think we are the Registry and you can dump anything on us. You are one counsel who believes you can simply foist your stick here to get a hearing. This is not the procedure,” an anguished CJI said.
