The Centre on Wednesday came out with the ownership rights charges for Delhi’s 1,797 unauthorised colonies that will be regularised. The costing, based on two types of land — gram sabha and private land — entails a minimum of Rs 14.55 per sq mtr to a maximum of Rs 4837.50 per sq mtr. The rates have been fixed for three types of carpet areas — plots up to/equal to 100 sqm, more than 100 sqm to 250 sqm and more than 250 sqm. It means one has to pay a minimum of Rs 1,455 and a maximum of Rs 12.09 lakh. (See chart on Page 4)

According to “the National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Regulations, 2019”, for regularisation of unauthorised colonies, the charges will be valid for a period of one year from the date of notification of these regulations and thereafter, eight per cent per annum simple interest will be recovered on late payment. The residents can pay the charge in three equal instalments.

The move to regularise the unauthorised colonies in Delhi is likely to benefit 40-50 lakh people. According to the Ministry, the charge of ownership right has been calculated on the carpet area basis for each house.

For a resident holding multiple properties, the rate of charges will be determined by clubbing carpet areas of all properties of the resident in all unauthorised colonies.

For vacant plots, the ownership or transfer rights shall be granted based on the area of plot and the nominal rate of 0.5 per cent, 1 per cent and 2.5 per cent depending upon the size of plots less than 100 sqm, 100 to 250 sqm and greater than 250 sqm in the Government land and half of these amount if the plot is situated on the private land.

As per the regulations, ownership right will not be available over prohibited land, that is, land falling in reserved or notified forests or land identified as protected or prohibited area by the Ancient Monuments and Archaeological Sites and Remains Act, 1958 (24 of 1958) or land falling in Zone-O, Yamuna Flood Plain.

The ownership right will also not be available over land falling in right of way of existing roads and Master Plan Roads, land under right of way of high tension lines, land falling in ridge area of Delhi and land reserved or protected under any other law for the time being in force.
