The Supreme Court has rightly declined to entertain a plea to issue directions to politicians not to indulge in hate speeches. Every politician should exercise restraint while delivering speeches.
The courts cannot control every individual. Inflammatory speeches produce more heat than light. Election speeches should not merely be an exercise to win votes. The forum should be used to unearth the truth and expose the persons who are against the interest of the people and the nation.
The Constitution of India, as the Supreme Court has rightly pointed out, has guaranteed freedom of expression. It should not be misused. Cases of hate speeches can be dealt with on the basis of merit and as per existing laws. The Supreme Court has also observed that hate speech is a matter of perception. And, just because the Supreme Court has declined to entertain the petition, the existing laws will not remain idle to take on personal attacks coupled with hatred.
