It's high time to abolish triple talaq completely

Ganapathi Bhat

This refers to the editorial, “Scrap this triple talaq” (December 10). The Allahabad High Court has lent a forceful voice to those oppressed voices that were craving for the abolition of triple talaq since a long time. The court’s observation is heartening in the sense that it reflects the mood of the higher judiciary towards the rights of Muslim women.

Dissolution of marriage cannot be as easy as uttering one word thrice, or jotting them down on a paper, or through SMS, especially when it is inarguably a painful process of separation of two individuals. The Allahabad High Court has meaningfully said that divorce was an “extreme emergency”. The court’s observation that “instant divorce” should be a big “no”, is welcome. Personal laws of a religion cannot impeach the subject matters enshrined in our Constitution. The Supreme Court, which is hearing numerous cases involving triple talaq and uniform civil code, should strike the right note on women's rights.
