Will table probe panel report during winter session, HC told

A day after it opposed a petition seeking the tabling of the Adarsh inquiry commission report in the Maharashtra legislature, the Maharashtra government on Tuesday made amends and informed the Bombay High Court that it would table the crucial probe report in the Assembly during the ongoing winter session of the State legislature in Nagpur.

In a submission made before a HC division bench of Justices V M Kanade and M S Sonak hearing a petition filed by the BJP’s Maharashtra unit, Assistant government pleader G W Mattos said that the Maharashtra government would table the Adarsh inquiry commission report in the State Assembly during the current winter session.

The Congress-led DF government’s climb-down on the issue came less than 24 hours after the high court demanded to know from it if it was tabling the two-member inquiry commission report on the Adarsh scam in the Maharashtra Assembly, in the ongoing winter session of the State legislature.

Refusing to go into the merits of the DF government’s contention that it was not mandatory under section 3(4) of the Commission of Inquiry Act for it to table the inquiry report in the State legislature, the same two-member HC division bench had on Monday directed the Prithviraj Chavan dispensation to let the court know by Tuesday if it would table the report in the Assembly during the winter session.

Declining to accept the state government’s plea for the dismissal of a petition filed by BJP MlA Yogesh Sagar and party spokesperson Atul Shah, the HC bench had observed: “Whether or not it is mandatory for the government to table the report we will consider later but first tell us if the government plans to table the report in the ongoing winter session”.
