State SIT defied SC order in Saradha case?

Saugar Sengupta

In a clear instance of deception and defiance of Supreme Court order, the Special Investigation Team of West Bengal Police that was investigating the Saradha chit fund fraud before the Apex Court directed their transfer to the CBI for some mysterious reasons held back at least 7-8 cases from the CBI. Instead, the State police defied the Apex Court order by submitting Final Report on the said cases.

Technically speaking a Final Report in regard to a particular case is an account given by the police to the court requesting the closure of the said case due to lack of evidence. According to CBI sources out of the stated cases two are from Kolkata, two from North Dinajpur and at least one from Midnapore. After the Supreme Court order to transfer all the Saradha cases to the CBI the latter had written to the ADG CID seeking compliance of the court order following which the chit fund cases were transferred to the central agency.

However “it has been recently found that at least 7-8 cases were not transferred” and more mysteriously the police filed the final report ending the cases the CBI sources said adding all these happened on the face of the Supreme Court order. The CBI were trying to find out whether more such cases were “hurriedly hushed up” and if so whose interest the SIT was trying to serve. If found true then some top police officials including IPS officers could be in trouble sources said adding the Agency had called for the relevant copies of those cases from respective courts.

Reacting to the reports retired Justice BP Banerjee of Calcutta High Court said “if whatever is being told is true then the police have committed contempt against the highest court of the country.” Amjad Ali senior counsel of Calcutta High Court said “such a blatant defiance act of the police demands a thorough probe and if proved then the officers responsible for this act of trying to deceive the Supreme Court to serve the interest of some political people should be given exemplary punishment.”
