SC relief to Maggi-makers

PNS

Maggi manufacturer Nestle India secured a major victory against the Centre on Wednesday after the Supreme Court stayed proceedings in a suit filed by the Centre before the National Consumer Commission. The court also accepted Nestle’s plea to get the noodle samples to be tested at a Mysore lab instead of Chennai, as directed by the Commission last week.

This is the second major relief for the company considering the fact that on Monday the apex court refused to stay an order passed by the Bombay High Court which set aside the ban on sale and manufacture of the product.

Issuing the order on a fresh petition filed by Nestle India, the Bench of Justices Dipak Misra and PC Pant decided to hear the matter on January 13 together with the earlier appeal of the Food Safety and Standards Authority of India challenging the Bombay HC order.

Appearing for Nestle, senior advocates Harish Salve and lN Rao felt that National Consumer Disputes Redressal Commission (NCDRC) had no need to order fresh test on Maggi at Chennai lab when on October 15, the Commission had sent samples for testing to Mysore. Salve said the Mysore lab was well equipped to which even A-G appearing for Centre agreed.
