SC: Kashmir problem can't be solved by judicial orders

PNS

The trouble in Kashmir has to be dealt politically as it cannot be managed judicially by issuing an order, said the Supreme Court while disposing a petition by a senior advocate from Jammu and Kashmir who sought imposition of Governor’s Rule following the tension that prevailed in the State after the death of Hizbul Mujahideen terrorist Burhan Wani.

Incidentally, since the petitioner Bhim Singh also heads a political party in the state - J&K National Panthers Party, the bench headed by Chief Justice TS Thakur asked Solicitor General Ranjit Kumar to facilitate a meeting of the petitioner with Prime Minister Narendra Modi, who met Opposition leaders from the state on Monday.

But dismissing the petition to impose Governor's Rule, the bench said, “This issue has various dimensions and therefore should be dealt politically and moreover, everything cannot be managed within the judicial parameters.”

The petitioner, who accepted the Court's offer, expressed apprehension that the “RSS-dictated” government would not invite him. The bench warned him, “Don't make a political statement here.” SG agreed to talk to Home Secretary for facilitating a meeting with PM.
