“Directorate of Education is asked to take instruction. They will file a short affidavit with regard to the averments made in the writ petition,” the bench said.

The court was hearing a PIl filed by by an NGO Justice For All through advocate Khagesh B Jha, who submitted that this is for the benefit of the children residing in the neighborhood and not getting admission in the recognised unaided schools situated at concessional land allotted to them for running unaided private schools”.

“Director of Education of Delhi government has failed to ensure the compliance of terms of allotment letter regarding admission of children of the locality in the recognised unaided schools situated at the land allotted by Delhi Development Authority and the Central government... To perform their statutory duty to initiate action against lessee which is not abiding terms of allotment letters issued by land owing agencies,” the plea said.

“The plots reserved for school was primarily allotted to run government school but in the case government has has not enough resources to start a new school it sponsored some charitable societies to start unaided private school so the resident of locality should not suffer,” the plea said.

It further submitted that the land was allotted at highly concessional rates to the societies accepted the terms and conditions of land allotment and signed the contract with the DDA and the Centre for this purpose.
