Fresh FIR must against Kani, CBI tells SC

PNS

The Central Bureau of Investigation (CBI) on Monday told the Supreme Court that a fresh FIR was required to be filed against DMK MP K Kanimozhi and others belonging to Kalaignar TV after a purported phone conversation showed attempts to scuttle 2G spectrum probe by the accused who later produced forged documents to suggest they had resigned from the company.

In its latest status report to the Supreme Court, the CBI special counsel KK Venugopal informed the court that the agency proposed to lodge FIR against the said accused under IPC offences 120B (criminal conspiracy), 193 (giving false evidence), 467 (forging documents) and 468 (forging for purpose of cheating) among other sections.

The Bench of Chief Justice Hl Dattu and Justice Arun Mishra posted the matter for hearing on April 30, wondering whether there was need to first hear the accused before ordering investigation against them. Venugopal said that though the case related to IPC offences, it could still be tried by the 2G special court as decided by the apex court while dismissing similar objection raised in the Essar-loop case.

In a related development, the Bench disposed an application by BJP senior leader Subramanian Swamy to stall transfer of Joint Director Ashok Tewari, a supervisory officer in the Aircel-Maxis probe, giving liberty to the aggrieved officer to plead his own case before court.
