The Enforcement Directorate has accused former Finance Minister P Chidambaram’s son Karti-linked company Advantage Strategic Consulting of filing a frivolous petition in the Madras High Court against its ongoing probe in the Aircel-Maxis scam.

In an affidavit filed before Justice MM Sundresh on Monday, the ED said the matter comes under the Supreme Court whose 2G Bench is monitoring the case and no other court can interfere the matter seeking dismissal of the petition by the company.

Arguing before the HC, Anand Grover, the Special Public Prosecutor of 2G cases and G Rajagopalan, the Additional Solicitor General, said the ED’s raids at the Advantage Strategic Consulting Private limited and interrogation of its directors were related to the Aircel-Maxis scam.

The prosecutors urged the HC to reject the petition citing Supreme Court’s two judgments in 2011 and 2013, barring all courts to deal with petitions related to 2G and Aircel-Maxis scam matters. They also said that the HC had already rejected Maran family’s petition on the same matter.

BJP leader and petitioner Subramanian Swamy also intervened in the petition. He accused Karti and his company of coming to the High Court with “unclean hands” without revealing that the matter was a Supreme Court monitored matter.

The prosecutors informed the HC that the ED’s chargesheet filed against Marans also mentioned Karti-linked company’s money trail related probe. The company was represented by battery of lawyers led by Karti’s mother Nalini Chidambaram.

The company had approached the HC a few weeks ago alleging that the ED was harassing them and urging a stay on the ED’s probes.  Grover and Rajagopalan told the HC that they could not share any documents to any court except the Supreme Court’s 2G Bench.

The case has been posted to April 6 for further hearings, as the company sought time to reply to ED’s arguments and affidavits.
