NEW DELHI: The Election Commission of India (ECI) has clarified that voters whose names are missing from the draft electoral rolls during the ongoing Special Intensive Revision (SIR) can submit Form 6 to seek inclusion in the final electoral roll, even if they were enrolled previously.

In its clarification, the Commission said submitting Form 6 in such cases would not amount to making a false declaration and would not, by itself, invite legal action under Section 31 of the Representation of the People Act, 1950.

The clarification refers to the Delhi High Court's October 14, 2026, order in Nilotpal Datta & Anr. v. Election Commission of India & Ors.

According to the ECI, no action under Section 31 shall be initiated against an elector solely for submitting Form 6 during or after the SIR process, provided the person is not already enrolled in another Parliamentary or Assembly Constituency and the declaration complies with the applicable legal requirements.

The Commission has also directed the Chief Electoral Officers of all States and Union Territories to publicise the clarification widely through available media platforms and in local languages to ensure that voters are aware of the procedure.

The clarification is expected to address concerns among previously enrolled voters who find their names missing from the draft electoral rolls and are seeking inclusion in the final list.
