Centre to SC: Aadhaar scheme can't be faulted over privacy

Abraham Thomas

The Government’s stand on Right to Privacy not being part of any Fundamental Right has raised many questions after it came to light how Centre took diametrically opposite view on the issue while defending the scrapped Section 66A of the IT Act.

In defence of the Aadhaar card scheme, the Government had argued in the Supreme Court that the scheme cannot be faulted for intruding citizens’ privacy. Such a right, the Attorney-General argued, does not exist in the Constitution and to link it with Article 21 (Right to life) cannot be accepted as two decisions of the apex court laid down that privacy cannot be a Fundamental Right unless provided by the Constitution.
