The Central Bureau of Investigation (CBI) investigating into the wider conspiracy angle of the Saradha and other chit fund cases on Tuesday petitioned the High Court praying for the cancellation of Transport Minister Madan Mitra’s bail.
Mitra who was behind the bars for the past 11 months had been granted bail by a vacation lower court. The lower court had erred in passing an “illegal order” without going through the case diary and without issuing notice to the public prosecutor, CBI counsel Raghabacharulu said.
He also added the claim by the defence that a notice was served on the PP at 12.30 pm on Friday to present the case diary within a couple of hours was also fallacious as “the order to submit case diary within that short period is an impractical order.”
The petition filed before the Division Bench of Justices Harish Tandon and IC Das was likely to be taken up on Thursday sources said.
Meanwhile Mitra who had been in hospital ever since his arrest and who had within 24 hours of the bail been declared fit by the doctors of Government-run SSKM Hospital -- leading to the Opposition claiming the veracity of the claim of his illness all these months -- was on Tuesday again admitted to a private health facility with complaints of uneasiness.
