The Bombay High Court on Friday refused to stay the ongoing trial in Shakti Mills gang-rape case in the city sessions court, in the face of an allegation that the trial court judge is not properly recording the defence plea in the evidence.
Hearing a plea made by the three of the accused in the case seeking a stay on the trial or transfer of the case in the court to another court, Justice G S Patel of the vacation bench of the HC observed: "We shall not stay the trial. let the proceedings go on in the sessions court". The HC judge asked the lawyers representing the three accused to make a proper representation of their clients' plea. The plea for transfer of the case to another court originates from a letter written by three accused in this case, alleging that the trial judge was not properly recording defence plea in evidence.
