Advocate Prashant Bhushan approached the Supreme Court on Wednesday for registering an FIR against former Supreme Court judge Justice Chandramouli Kumar Prasad and his removal as Press Council of India Chairperson over allegations of criminal misconduct and abuse of office as a judge of Supreme Court.
The allegations revolve around an order passed by Justice Prasad while he was heading a bench in Supreme Court which allegedly favoured a private construction firm Mistry Constructions. Bhushan testified in his petition that “the main owners of Mistry Constructions were the in-laws of a former associate who worked with Justice Prasad during his legal practice”.
Besides, “the lawyer who appeared for the firm - senior advocate AK Srivastava shares chamber (90, lawyers Chambers, Supreme Court) with Mr. Ardhendumauli Kumar Prasad, the son of Justice Prasad. Thus Justice Prasad was aware of this case and had an interest in the matter.”
On the charge against Justice Prasad, Bhushan claimed that a case related to Mistry Constructions was being heard by a three-judge Bench of which Prasad was not a member. An unrelated case for hearing before Justice Prasad got tagged with the above matter raising suspicion as none of the lawyers made any request.
