Talwars rubbish CBI's 'sudden provocation' theory

SP Singh

In the Aarushi-Hemraj double homicide, lawyers defending the Talwars reiterated their stand to demolish CBI’s theory that parents killed their daughter and the servant following a sudden provocation after seeing the two in a compromising position.

Defence lawyer Satyketu Singh submitted that when Hemraj’s body was found the next day, chappals were found on his feet. “Can a man go for sexual intercourse with chappals onIJ” Singh asked.

Secondly, tests could not establish presence of any bodily fluid on either Hemraj or Aarushi’s clothes, while CBI claimed that Rajesh Talwar clubbed them both with a golf iron due to which the blood spatter on walls were seen at a height of 10 feet. “If blood could be seen at a height of 10 feet, why was no biological evidence detected through testsIJ” Singh asked.

Thirdly, Dr Naresh Raj claimed when a person dies during coitus, the phallus remains tumescent. He reaffirmed that his claim was from personal experience but his statement was contradicted by Modi’s Medical Jurisprudence and Toxicology that 18 hours after death, the abdomen distends, eyeballs prolapse and the male genitalia turns turgid. On all these accounts, the CBI theory is demolished in entirety, claimed defence lawyer Manoj Shishodia.
