The judgement in the Aarushi-Hemraj double murder case will come on November 25. The court of special CBI judge S lal pronounced the judgement date after hearing the final arguments of the defence lawyers who discarded the entire CBI theory on commencement of the crime.
Talwars’ lawyer Satyaketu Singh submitted that the CBI has failed to establish the unbreakable chain of events. At one point of time, it claimed that Talwar killed the duo out of sudden provocation. He picked up a golf stick, rushed to Hemraj’s room and clubbed them to death. The second injury to Aarushi’s neck could not be sudden provocation. It would have been executed in a well-thought out plan. While at the same time, it doubted servants and applied to seek the custody remand and finally withdrew to seek the remand. And earlier also the CBI had submitted the final report in absence of convincing evidence.
But CBI has failed to establish the chain of events affirming the crime and claim that Talwars could have killed the duo in absence of outside entry which is full of lapses. The entire theory of CBI depends on probability which is against the spirit of law. Former UP Police officer KK Gautam also claimed that he noticed three depressions on Hemraj’s bed which suggested that there was an outsider in the house, so the CBI theory is full of lapses, claimed the defence lawyer.
Aarushi, 14, was found murdered at her parents’ Noida residence on May 16, 2008. The body of Hemraj was found the next day on the terrace of the house. The prosecution must present unbreakable chain to establish certainty but here in this case the CBI filed closure report in absence of evidence how they can generate evidence against either added Satyketu Singh.
