Retired Colonel's bail plea not taken up on Monday

Bail application of the Jet Airways official who was arrested early on Sunday by the Uttar Pradesh Police, could not come up for the hearing on Monday as the name of the accused was wrongly stated in the arrest memo as Avneet Singh Seth instead of Colonel (retired) Avneet Singh Bedi.

The court of Chief Judicial Magistrate (CJM) has summoned the accused on Tuesday to hear his bail plea on the application of the defence lawyer for the wrongly stated name.

Earlier on Sunday, the accused was produced before the remand magistrate who sent him to judicial custody to be produced before the regular court of CJM on Monday.

Defence lawyer Sudhir Tyagi filed an application before the court in which he attracted the court attention that the name of the accused, in arrest memo, was wrongly stated as Avneet Singh Seth instead of Avneet Singh Bedi.

The defence lawyer submitted that the accused’s aadhar and voter identity cards have been enclosed with the application to correct his name in all court records including arrest memo which the court accepted and summoned the accused to be produced before the court on Tuesday.

Tyagi said that it appears to be ploy by the city police to detain him in judicial custody as much as possible. If the bail plea was heard on the basis of old records, it could further complicate his release from the jail.

On the basis of arrest memo, the accused was lodged in Dasna jail under a wrong name so all efforts for his bail could have become futile since bail, if granted, could have been granted on Avneet Singh Bedi and when release memo would go to jail, the jail authorities can deny the release on the basis of different name. So it was necessary to correct the name first before any court proceedings, Tyagi contended.
