lieutenant-Governor Najeeb Jung has turned down the two magisterial enquiries ordered by the Arvind Kejriwal Government. The Chief Minister had ordered two separate magisterial enquiries into a violent clash at Burari in which two Aam Aadmi Party MlAs were among those booked and an alleged gangrape of an African woman in a moving car in East Delhi. Top sources told The Pioneer that files have been sent back to the Chief Minister’s Office in this regard and the lieutenant-Governor is believed to have suggested the Chief Minister that these incidents are directly linked with law and order hence magisterial enquiries cannot be ordered.

According to sources, the lieutenant-Governor has made it clear that magisterial enquiry cannot be instituted in these cases. In the rape case, no magisterial enquiry is required as all the four accused have been arrested and there is no need to probe on the part of investigation by the magistrate. On the violence in Burari, the sources said, the lieutenant-Governor observed that no magisterial enquiry is required. An enquiry by a senior police officer may be instituted as the incident is directly linked with law and order.

Two Aam Aadmi Party MlAs had reportedly clashed with Delhi Police personnel in Burari. They had alleged that the police did not register a case against those involved in allegedly molesting two kids. A Press release issued by the Government then had stated that Delhi Government treats safety of children as an important issue and was committed to put an end to such shameful incidents.

“It has been decided to institute a magisterial enquiry under the District Magistrate (North Delhi) to inquire about the circumstances and causes that led to this incident and to fix responsibility of Government officials, agencies and elected representatives, any of whom may have acted against the law,” it said. The probe was announced as the BJP attacked Kejriwal asking him to explain his stand on the conduct of his party MlAs who were involved in hooliganism and said the incident reflected the arrogance of Aam Aadmi Party.
