Emboldened by a High Court order in a North Delhi Municipal Corporation (NDMC) pension case, Delhi BJP on Wednesday asked Chief Minister Arvind Kejriwal to apologise for leveling "false" allegations against party councillor Shobha Vijendra,  the wife of BJP MlA and leader of opposition in Delhi Assembly Vijender Gupta.

Delhi High Court on Tuesday stayed a direction by Chief Information Commissioner (CIC) to Shobha, a councilor in NMCD, to explain how she had authorised disbursal of pension to a woman who was not eligible, terming the order "strange".

"The CIC order came on May 13 and the next day the AAP leaders and the Kejriwal Government leveled allegations of `2500 crore scam by the councillor. Chief Minister Kejriwal himself had alleged in Vidhan Sabha BJP was involved in pension scam involving crores of rupees," said Gupta.

Gupta told that Dr Shobha had filed the petition in the Delhi High Court against unilateral, illegal, unconstitutional and wrong order passed by CIC.

"Hearing the petition, the learned Justice Sanjeev Sachdeva reprimanded the Delhi Government and CIC and said that order dated 13th May passed by the ClC amounts to "usurping powers of the court" as CIC does not have powers enjoyed by the High Court for issuing such an order. CIC has violated fundamental right of the plaintiff without giving her an opportunity of hearing.

Kejriwal Government hatched a "conspiracy" to defame BJP at the time of municipal bye-elections and now after the stay of the CIC order by the court "we ask Kejriwal and his Government to seek apology from the all the municipal councillors", said Delhi BJP president Satish Upadhyay.
