Allahabad HC orders halt on construction

After order to demolish Supertech’s twin 40-storey towers in Noida’s Sector 93-A last month, Allahabad HC on Thursday ordered a stop on construction of Jaypee Group’s project in Sector 134. High Court gave the order considering the issue of land use change by Noida Authority. Court asked the State Government and concerned authorities to file a reply before July.

A bench of Justices Vineet Saran and NA Munis, while hearing petition of Kaluran and others, ordered a stop on construction activity till the next hearing. The court said that land use cannot be changed by authorities without any specific reason and in this case, it reflects the land was acquired for other reasons.

It may be noted that Noida Authority had acquired about 17 bigha land from farmers of Ghejha and Tiltabad villages (Sector 134) in 1995 on the pretext of incorporating developmental projects. In the beginning of 2014, it revealed that land has been allotted to Jaypee Group, which has announced a township project called Jaypee Greens Kosmos. As construction work started, farmers approached the authority and later moved Allahabad High Court. Meanwhile, farmer bodies have welcomed the decision of the court.

“As we have been fighting for farmers’ rights, the decision strengthened our stand and allegations of the authority working for the benefit of realtors only,” said Dushyant Nagar, a farmer rights activist and convener of Kisan Sangharsh Samiti (KSS).
