In an interim relief to the petitioner Nishant Kumar, the Delhi High Court accepted his plea and granted him the permission to appear for Delhi Higher Judicial Service Examination. The HC judgment followed the verdict of the Supreme Court last month in which it allowed magistrates and judges of lower courts to appear for the examination for Additional District and Session Judge (ADJs).
The Bench of Justices GS Sistani and Sangita Dhingra Seghal has directed the concerned authority i.e. Delhi HC itself to “provisionally receive the application of the petitioner”.
The petitioner, Nishant Kumar, is Secretary (Civil Judge), District legal Service, Dumka District in Jharkhand and has plead the HC through his counsel that the application be accepted provisionally as directed by the SC in its order dated February 15.
The Bench granted permission after hearing the arguments of counsels Rakesh Kumar and Anil Kumar Sahu. On behalf of the petitioner, advocates Rakesh Kumar and Anil Kumar Sahu argued that by not accepting the experience of judicial work as equivalent to the work experience of Judicial Officer, the constitutional right of equality of judicial officers has to be disregarded.
