Even as the face-off between Delhi Police and Delhi Government over breach of jurisdiction escalated with the former launching a parallel probe into the bribery case involving a head constable (HC), Delhi Police quoted rules to denounce the raid by Anti-Corruption Bureau (ACB) of Delhi Government.
The notification issued by the Ministry of Home Affairs (MHA), which has been accessed by The Pioneer, suggests that officials of the Central Government do not come under the ambit of the State’s vigilance unit. This is, according to sources, in contradiction to jurisdictional claim of the ACB to register an FIR against Delhi policemen.
The notification dated July 15, 2014 was issued by the MHA. It reads as: “…guidelines issued by the Central Vigilance Commission over the
jurisdiction of the Central Bureau of Investigation and the Anti-Corruption Branch, Government of National Capital Territory of Delhi, the Central Government hereby declares that the notification number F 1/21/92 Home (P) Estb. 1750, dated the 8th November, 1993 issued by the lieutenant Governor of the National Capital Territory of Delhi shall be applicable to the officers and employees of that Government only and for that purpose amends the said notification.”
The notification further reads: “This notification shall apply to the officer and employees of the Government of National Capital Territory of Delhi.”
According to the sources, Delhi Police would conduct a thorough probe into the matter and they could move court against the officials of ACB for encroaching their territory. Delhi Police has already registered a case and started a vigilance enquiry into the matter.
Sources said that the FIR lodged in the alleged corruption case, in which a Delhi Police head constable identified as Anil Kumar was arrested nowhere said that the accused was arrested while taking money, as the demanded cash was not recovered from his possession. The ACB had claimed that Anil was caught red-handed while taking bribe of Rs10,000 in North-East Delhi’s Sonia Vihar area. Delhi Police claimed that the detention of Anil was staged as the place of his detention shown in the FIR is different from the actual place where he was nabbed.
Delhi Police on Tuesday had claimed that the complainant, who is a scrap dealer, into the alleged corruption case is already facing several criminal charges in East Delhi. A senior police officer told The Pioneer that the complaint who had informed the ACB about bribe demanded by the three policemen is involved in cases of robbery, rape and arms act. Police believe that the authenticity of the allegations levelled by the complainant is doubtful and should be completely verified.
