Tussle between the Delhi Development Authority (DDA) and private builder Emaar MGF over the construction on excess area has been resolved in the authority meeting with lieutenant Governor Najeeb Jung, sources said on Wednesday.
In the meeting, it has been decided that extra Floor Area Ratio (FAR) will be given to the Delhi Development Authority (DDA). The issue was related to the construction of the commonwealth flats beyond the compoundable limit area that comes to about 12841 square meters.
The controversial land area includes residential area of 11,964 square meters while on 876,67 square meter of land, community centers and clubs have been constructed. As per the sources, the DDA will acquire the whole land and further, there will be no more share of private builders on the disputed land.
“Earlier, only one third of the land was under the DDA and two thirds was with developers, but now the whole land will be acquired by DDA,” said a source.
The total area used by Emaar MGF for construction is 2,28,238,25 square meters including residential and areas of community centre. However, the area sanctioned by the DDA was 2,05,140,00 square meters. And the total permissible compoundable area under the development code was 10,257 square. While at the site, the total area with compounding comes to 2,15,397 square meters.
Earlier, the DDA alleged that private builder exceeded FAR by constructing extra flats in the entire project. Under this project 1,168 flats were constructed in 34 towers and the DDA awarded the completion certificates to 30 towers out of total 34. These 30 towers have over 1000 flats.
Due to the matter of constructing extra flats and expending FAR by Emaar MGF, the DDA withheld the certification of the rest of the towers.
In the authority meeting, the policy of installation of lifts was also discussed. Under the policy, the unauthorised construction has been delinked while processing the case for NOC and DDA has in principal granted NOC in the policy itself to DDA flat owners in de notified areas.
“The policy has also been extended to Cooperative Group Housing Societies (CGHS) flats. Therefore, the allottees of de-notified areas, whether of DDA flats or CGHS flats, need not approach DDA for NOC and the concerned local body shall grant permission/ NOC at their end,” said a senior official, DDA.
The proposal for State guest house under Master Plan of Delhi (MPD) 2021 and change of land use of site measuring 3.74 hectare from residential land use to Public/Semi Public Facilities for solid waste management facility at Maidangarhi near IGNOU Campus in Zone J was also discussed.
