The Delhi Commission for Women (DCW) has opposed the interim bail of the 26-year-old man who allegedly raped his 8-month-old cousin sister in January earlier this year.
The accused has applied for bail citing illness of his child. The DCW alleged that the accused submitted only an Outpatient Department (OPD) prescription as proof for the child’s illness.
Further, the DCW claimed that the child of the accused lives in a joint family and has his mother and grandparents to support him. The Commission stated that they intend to oppose the bail in the court.
“The Commission’s Rape Crisis Cell, which has appointed lawyers in all courts trying rape matters, opposed the bail application in Court, along with, the Public Prosecutor. The Judge has sought details of the illness of the child of the accused to take further decision in the matter,” DCW spokesperson stated.
Earlier this year, the 8-month-old was brutally raped by her 26-year-old cousin brother and was inflicted with severe injuries and had to be operated twice.
DCW Chairperson protested the rape with an indefinite hunger strike and demanded death penalty against child rapists. Centre passed a law awarding death penalty to rapists of children within 6 months.
DCW chairperson Swati Maliwal said, “The rapist of the 8-month-old baby should not be given bail. His child is being looked after by his parents and wife. This man has brutally inflicted horrendous injuries to an 8-month-old child and should not be spared. He may also exert undue influence on the parents of the survivor as they are close relatives. Moreover, testimony of the mother of the child survivor is yet to be recorded. In fact, under the new law he deserves to be given the death penalty within 6 months!”
