HC reserves decision on office of profit case

Rajendra S Markuna

The High Court of Uttarakhand on Tuesday, reserved its decision on the much talked about office of profit case related to Agriculture Minister Harak Singh Rawat.

The court has come to a conclusion after hearing the case today, said Ajay Bhatt, leader of Opposition in the State legislative Assembly,  while talking to The Pioneer.

It should be noted here that it was Bhatt, who on behalf of  the BJP, challenged occupation of posts in three corporations by the Agriculture Minister in the High Court.

Now the High Court may pronounce its judgment in this case of office of profit any day within a week, though the date has not been fixed by the court, added the leader of Opposition.

Earlier the High Court, in its decision on May 28, had postponed hearing in this case till June 11. Since the High Court has reserved its judgment in this case now, therefore, nothing can be said on this case at this juncture, Bhatt  further said. However, whatever be the decision of the High Court, it would be acceptable to all, he maintained.

The much talked about office of profit case is now being closely followed by both the State Government and the Opposition BJP which had challenged Rawat's position in Court.

The BJP strongly raised the office of profit issue, describing the holding charge of three corporations by the Agriculture Minister as ‘unconstitutional’.

Subsequently, Rawat resigned from the corporations after BJP’s strong opposition on this issue, but  it was  not enough for the BJP.

It moved the High Court with the contention that how can an accused be pardoned after he or she commits a crimeIJ Besides, as the leader of Opposition has maintained, the way the State Government brought an ordinance to save its Minister on the issue only proves that Rawat was holding offices of profit. It is a clear violation of the constitution the way the State Government brought an ordinance to save its Minister, he added.
