A Himachal Pradesh High Court judge on Tuesday recused himself from hearing a petition of Himachal Pradesh Cricket Association (HPCA) for quashing of FIR lodged against the association by the State anti-corruption and vigilance bureau.

The HPCA had filed the petition on Monday for quashing of the FIR, which was taken up for hearing in the court of Justice Rajeev Sharma on Tuesday. As soon as counsel for the HPCA pleaded for quashing of FIR, Justice Sharma cited personal reasons to recuse himself from the hearing and asked the petitioner to approach the court of acting Chief Justice Mansoor Ahmad Mir.

Justice Sharma said that since the petitioner had prayed in another petition of the association to implead Chief Minister Virbhadra Singh and others in the case for which order has been reserved by the High Court, he could not hear the case. According to counsel for HPCA, Justice Rajeev Sharma had been counsel for Virbhadra Singh before becoming a judge of the Himachal Pradesh High Court and for the said reason he recused himself from hearing the case.

Petitioner HPCA in its petition had pleaded that FIR number 12/2013 lodged by Vigilance Bureau at Dharamshala on August 1, 2013 should be quashed as it was around four-five months since the probe and no major breakthrough had been made by the investigating agencies and case was still under initial investigation.

Petitioner has also said that it has been alleged that by committing fraud the HPCA has converted itself into company from society but actually it was done under Company law and HPCA was now a not for profit company registered with company registrar. Counsels for HPCA after Justice Rajeev Sharma recused himself from hearing the case, then approached the court of acting chief justice and the matter was listed for hearing on Thursday.
