long after the immortal bard Shakespeare yelled “Frailty, thy name is woman”, advocate Byomakesh Tripathy has stolen the wind out of the sails of the universal poet and has formed an institution in the name and style of ‘The Purusha Commission’ since 2012. An ardent champion for the cause of the lacerated males left cuckolded and anguished by the fair sexes; Tripathy, a lion under a sheep’s clothing, is ready to hit the bull’s eye through his outfit. Tripathy’s bandwagon evokes response not only here in his home State but also receives wide acclaim and appreciation from 22 other States of our country by now.
A young man with many parts, he has received National Youth Award in the year 2008 by President APJ Abdul Kalam, Red & White Bravery Award 2004 by Chief Minister Naveen Patnaik, Biju Patnaik State Youth Award 2004 & 05 by the CM, Bhubaneswar Gaurav Sanman 2005 & 06 by the Government of Odisha, Prakruti Mitra Puraskara by the State Department of Forests & Environment, International Youth Award 2008 by Government of Japan, Utkalshree Award by the Governor of Odisha and Scouts & Guide Award by the Government of Oman. He has also been awarded by the Consul General of Spain, the Consul General of Brazil, the Consul General of Costa Rica, the Queen of Oman, the Consul General of Venezuela.
“It is high time to plug the loop holes in our legal system as the torture of male persons by females has assumed overwhelming proportions by crossing all limits, while the women perpetrators escape under the labyrinthine layers of laws eminently suitable to the fair sexes, says Tripathy”. In an interview to The Pioneer, Tripathy spoke to Sugyan Choudhury from his residence at Neeladri Vihar in Bhubaneswar.
What is the motive behind the establishment of a ‘Purusha Commission’IJ
Men and women are social animals. One cannot exist without the other. Both are indispensable for each other. They should live with mutual trust on equality of status and on healthy relationship. But unfortunately, the law is always tilted in favour of ladies. Article 14 of the Indian Constitution envisages equal status and opportunity for both men and women. But it has been found since Independence that the law always goes in favour of women, leaving males disillusioned while the accused women are left scot-free. That is why we thought of establishing The Purusha Commission, which came into being here in Bhubaneswar since 2012. Many complaint cases have been registered through our commission since its inception.
Can you cite some glaring examples of torture of males by femalesIJ
Examples are countless and innumerable. Take for example a latest case of the brutal murder of a man by his wife named Deepika under the Mancheswar police station in Bhubaneswar. The incident occurred last week. The husband was found murdered and then was buried under a four-feet pit covered under concrete plaster. The accused woman confesses that she has committed the murder being tortured by her husband. This is a difficult proposition to be believed. It is impossible on the part of a single woman to commit such a heinous crime and then to dig a pit of four feet and consequently covering it under a concrete structure. It is sure that some other persons having extramarital relationship with the lady must have committed the crime in an accomplished way. The police are yet to arrive at a conclusion. Thus, it is clear that the husband has been murdered by an adulterous wife. Things will come out after the police submit their final investigation report/chargesheet.
Can you support your findings by any governmental records or by any from any other provisions of lawIJ
If you cast a look at the report of the NCRB (National Crime Record Bureau), in its report from 2005-14, you will find that the number of deaths in cases of married males is twice the number of married females. In most cases, the cases of deaths arising out of women torture against men never come to the fore. Section 493 of IPC is always suitable for women, by which a woman can and may have physical relationship with another male and then can deny the marriage without being prosecuted under law. However, the duped male cannot file an FIR against the woman. And again, a woman can blackmail a male person that you have to marry or else I shall lodge an FIR against you. Many coquettish women enter into physical relationship with young men but ultimately leave them forlorn resulting in suicides by men. But the perpetrator escapes under the innocuous ambit of the provision.
Similarly, Section 497 of IPC clearly states that a married woman having extramarital relationship with others cannot be brought under legal proceedings. Is it not amounting to male torture by femalesIJ In the same way, a married woman having evil designs can get arrested her husband, father-in-law, mother-in-law, brother-in-law and all by taking advantage of Section 498(A) of IPC, which comes under prohibition of Dowry Act. Section 354 of IPC has it that a case can be lodged against any male person who has touched a female by mistake or by intention. But there is no such provision to the contrary. If a woman assaults a male person, there is no such provision to bring her directly under legal proceedings. You might be knowing that very recently a woman slapped a male security official of the PMO (Prime Minister’s Office) while the latter was on his duty. All security officers were there, but they could do nothing against the erring woman. This is simply because there is no such provision to prosecute the offender woman.
