The Orissa High Court delivered its verdict on Jagatsinghpur Magistrate- police row case on Thursday.
The court expressed displeasure over the manner Jagatsinghpur police acted against a working Magistrate and did not abide by legal formalities before registering a case against the judicial officer.
A Division Bench comprising Justice Binod Prasad and Justice Sangam Kumar Sahoo spelled out the judgment and accepted the unconditional apology tendered by Jagatsinghpur district Superintendent of Police Sudha Singh and directed similar apology should be furnished before the lower court by the SP along with the complainant lady sub inspector Sabita Majhi who had lodged the case against the Magistrate. Besides, it cautioned the police to work as per law.
Notably, Sub Inspector S Majhi had lodged an FIR at Jagatsinghpur Police Station alleging that Jagatsinghpur Chief Judicial Magistrate [CJM] Satya Priya Mishra had misbehaved with her during presentation of a juvenile accused in court and the Magistrate had delivered castiest remarks against her.
Basing on the complaint, Jagatsinghpur SP Sudha Singh had instructed the then Jagatsinghpur Police Station for registering a case against the CJM. But the police had not obtained permission from the District Judge while registering the case.
