Taking cognizance of imprisonment of less than seven years old children under various sections of the IPC for juveniles due to unawareness of the child rights Act by police officials, Madhya Pradesh Human Rights Commission (MPHRC) has sought an explanation from the DGP and DIG, Bhopal.
Commission raised concern over the actions against the Protection of Child Rights Act. Under Protection of Child Rights Act no FIR should be registered for imprisonment less than seven years and no arrest should be done and even after the provisions under the act FIR is registered and arrest is done in violation of the act. In the state capital alone, around 40 cases have been registered at different police stations.
The organisations working for child rights when discussed the issue with SHOs of police stations, few of them expressed ignorance of the rules, laws and provisions which raises question of ignorance of police resulting into imprisonment of juveniles.
To address the problem in a proper way police should be made aware of Protection of Child Rights Act, rules and provisions under the act completely which would help in avoiding to keep the juveniles delinquents with the dreaded criminal.
These juvenile should be provided with protection by Child Right Police Officer according to law which would help them from turning dreaded criminals. They should be given opportunity to change and commission wants crime free society.
