Rs 85 lakh compensation for losing eyesight

Madhya Pradesh State Consumer Disputes Redressal Commission has ordered a hospital to pay Rs 85 lakh in a case of 2004 in which a girl lost her eyesight due to negligence of hospital.

The matter pertains to Ayushman Children Hospital located in Jabalpur. Here, due to negligence in operating the incubator, a child lost her eyesight forever.

Deepesh Joshi, lawyer of the innocent's father Shailendra Jain, said that this is a historic decision. Till now, such a huge compensation amount has not been imposed on any hospital due to negligence. This decision was given on September 14 by the bench of State Consumer Disputes Redressal Commission members AK Tiwari, Shrikant Pandey and DK Srivastava. Earlier, in the case of a stone clinic, the commission had imposed a fine of Rs 15 lakh.

Deepesh Joshi told that in 2004, when Shelendra Jain's daughter Sakshi was one year old, she complained to the Commission about the negligence of the hospital. Sakshi was a premature baby at the time of birth.

On the advice of doctors, he was kept in an incubator at Ayushman Children's Hospital. However, after a few days the girl recovered and her parents took her home. After some time she realized that she could not see anything. Many eye doctors were consulted regarding this.

Then it was found that the girl had retinopathy of prematurity.

Deepesh Joshi told that after all the tests of the girl were done, it was found that the girl has retinopathy of prematurity. This happened due to excessive dose of oxygen in the incubator. The negligence of the hospital has come to light in this regard.

Madhya Pradesh State Consumer Disputes Redressal Commission said, 'Due to the negligence of the hospital and doctors of the victim girl Sakshi Jain, it has been concluded that her vision has been lost for life and she has become blind. The possibility of it allegedly having an impact on her future life also cannot be ruled out.

Even from the social point of view, she will not be able to get the same place and respect as she would have been able to make her place in the society if she had had a normal life. She will need help for many tasks and her ability to earn a living will also be affected due to lack of eyesight.
