The new chief justice of India DY Chandrachud is a legal luminary and known for his tough decisions
It is official, Dr Justice Dhananjaya Y Chandrachud is the next Chief Justice of India (CJI). President DraupadiMurmu has appointed him as the new chief justice of India. He would take charge on November 9 and Justice Chandrachud. He would be the 50th chief justice of India. His name was recommended by the outgoing CJI UdayUmeshLalit on October 11. DrChandrachud will formally take the oath on November 9 and his tenure as the CJI will be till November 10, 2024. It is the longest term a CJI has served in the recent past. DY Chandrachud is a legal luminary who has many degrees to his credit. He graduated with his LLB from Delhi University and went on to study at Harvard on the Inlaks Scholarship from where he did his Leaders in Law (LLM) and later did his Doctorate in Juridical Sciences at Harvard (SJD). Justifying the phrase like father like son his father had also served as the chief Justice of India. His father, Justice Yeshwant Vishnu Chandrachud was the 16th CJI and the longest-serving CJI of India. he served more than seven years from 1978 to 1985. Justice Chandrachud has been in the apex court for over six years impressing the legal fraternity with exceptional jurisprudential acumen.
In fact, he has overruled a couple of the apex court's old decisions including some that his father wrote or endorsed. That speaks volumes about his integrity and sense of purpose. However, his appointment seems to have not gone down well with the government. In the wake of his appointment, KiranRijjiju the union minister for Law and Justice said that Indian wants to do away with the collegium system of appointment of judges, and the power to appoint the judges should rest with the government. This in a way shows the unease of the government with the new chief justice. In fact, DY Chandrachud was one of the four judges that came out to show their displeasure with the way the judiciary was being conducted. His tenure would last as long as the present parliament and a little more which could make the government a little uncomfortable as many of its decisions and policies are under scrutiny in the apex court including the decision to scrap article 370 and demonetization. This could be the reason for the BJP being at unease with him. Justice Chandrachud's tenure as CJI would indeed be critical for the country and the BJP alike.
