K'taka to decide on appeal to SC by May 21

Published on:

Even as the Special Public Prosecutor (SPP) BV Acharya submitted a report suggesting to the State Government to appeal against Jayalalithaa disproportionate assets (DA) case verdict in the apex court, the ruling Congress Government has not taken any decision to appeal against it. According to the sources, at a meeting scheduled for May 21, the Cabinet will discuss the SPP’s report along with another report submitted by the law department to take a final call on the appeal against the verdict in a week’s time.

A source in the State Government indicated that the Cabinet nod is awaited as per the rules and Chief Minister will take a final call on going against the verdict or not. Meanwhile, State law Minister TB Jayachandra, said that his office is yet to receive the opinion furnished by Acharya. The law Minister said since the Supreme Court had deemed Karnataka as the sole prosecuting agency, the State Government would arrive at a decision only after taking into consideration the opinions of the SPP, law department and the Advocate General (AG).

It is also learnt that based on SPP’s report, the AG has sent another report to the Government asking to finalise its stand. A source in the Government indicated it is a very sensitive case and is followed keenly across the country but the State Government is of the view that it should not err in executing the case by going for an appeal vying the pros and cons of the entire case looking at political implications.
