Kerala Hummer horror: Chargesheet tomorrow

Published on:

The chargesheet against controversial Kerala businessman Muhammad Nisham (39) in the sensational case pertaining to the brutal murder of Chandrabose (48), a security guard, is most likely to be submitted on Monday. Nisham had murdered the security guard by ramming his Hummer into him on January 29.

The investigating team claims to have collected strong evidences against Nisham from scientific examinations. Sources said that the preparation of the chargesheet was in the final stages and the investigators and Special Public Prosecutor CP Udayabhanu would meet on Sunday to give the final touches to the chargesheet.

Though the investigators had wanted to submit the chargesheet much earlier, the efforts got delayed as they were to get some crucial results of scientific examinations. The police do not want to delay the filing of the chargesheet as the court will adjourn for the one-month summer vacation on April 10. The Prosecution will also apply for hearing of the case by a vacation court.

Officials have received the results of the analyses of the blood samples collected from the crime scene. Results of the examination of the Hummer SUV Nisham had used for committing the crime, the shoes and dress he had worn at that time and the stick with which he had attacked Chandrabose have also been collected.

The analyses have confirmed that the traces of blood found on these articles were of Chandrabose’s blood. The comparative studies of the possible speed at which the Hummer was rammed into him and the injuries inflicted on his body because of this had also been completed, source said.

However, the absence of Chandrabose’s dying declaration and the dress he had worn during the time of the incident is causing some worry to the Prosecution. But officials said that they were confident about overcoming this with the solid evidences they have collected through the scientific examinations.

The failure of the police to record the dying declaration and to collect Chandrabose’s dress had triggered a huge controversy with allegations coming up to the effect that this was part of a deliberate plan hatched by some police officials to protect Nisham. The police had explained that Chandrabose’s dress was destroyed by the hospital where he was treated after Nisham’s attack.

Nisham had attacked Chandrabose, security guard of the posh Sobha City villa complex at Puzhakkal near Thrissur, in the early morning of January 29 for being a bit late for opening the gates first by beating him up, then ramming his Hummer into him when he tried to escape the attack and by beating him up again at a parking lot inside the housing complex.

The security guard was admitted to a private hospital in a critical condition. He died of multiple organ failure induced by Nisham’s attack on February 16. Nisham was arrested from the spot immediately after the incident and since then he has been in judicial custody. Though his wife Amal was present at the time of the incident, the police did not name her as accused.

There are about 80 witnesses in the case including nine eyewitnesses, one of whom is Nisham’s wife. That the statements of 10 of the witnesses including Amal had already been recorded as per Section 164 of the CrPC would prove advantageous for the Prosecution, sources said. Nine scientific evidences would form part of the chargesheet, they said.
