The National Human Rights Commission (NHRC) has once again asked the State’s Chief Secretary and Director General of Police (DGP) to submit reports of enquiry committee set up in the case on the alleged thrashing of an NTPC official by an IAS officer on February 10 last year and the action taken report on the four criminal cases registered in this regard.
The Commission, in a letter issued on January 25, further warned if they fail to submit their reports within four weeks, it will be constrained to issue coercive process under Section 13 of the PHR Act, 1993.
The DGP has been directed to inform the Commission about the status of investigation in the four criminal cases registered in the matter within four weeks. The DGP will also have to intimate the commission as to what action has been taken on the letter dated January 15, 2016, sent to him by the complainant.
It has further stated that keeping in view the principles of natural justice, a copy of the inquiry report be also provided to the complainant and has sought response within six weeks from the government.
The details of the case filed by Rakesh Nandan Sahay, then DGM (HR), NTPC Hazaribagh states that he was brutally beaten, abused and harassed by the then Deputy Commissioner, Hazaribagh Sunil Kumar on February 10 last year.
“Taking cognizance of the complaint, the Commission issued a notice to Chief Secretary and the DGP, Jharkhand calling for a report in the matter within two weeks. The requisite reports have not been received despite reminder dated 10.07.2015,” it states.
According to the Commission, the complainant has requested the Chief Secretary that three false cases registered against him should be withdrawn.
Sahay categorically stated that he had been subject to physical and verbal violence and his case was being ‘diluted’ by reasons well known to the administrative fraternity of the state. Sahay further stated that he was disgraced, humiliated, beaten and his dignity was torn apart by the then DC Sunil Kumar, who seems to have been nurturing personal grudge against the NTPC official for some unknown reasons.
The NTPC official further alleged that despite documented evidences that he was mercilessly beaten and injured, no action on his FIR had been taken.
Notably, four FIRs have been lodged in the case in Hazaribagh by both the parties and the CM had instructed the Chief Secretary to form a committee to probe the incident. The CS had formed a committee headed by the Additional Chief Secretary, Home to investigate into the matter and find out the truth. However, no concrete step has been taken by the government in this regard so far, claimed Sahay.
