Mukhiya candidate seeks reservation despite Apex court order

Published on:

Keeping authorities in the dark, LalitaBakhala, the Mukhiya  of Parswar Panchayat (Reserved for Scheduled Tribe Seat) of Bargarh block, took advantage of reservation and remained on the post of Mukhiya for five years, whereas according to the order given by the Supreme Court of India in a suit, LalitaBakhala was not entitled to reservation for contesting elections on any post in Jharkhand, because her native place is in Chhattisgarh.

This time again Mukhiya has followed the same link and filed nomination papers for the candidate for the post of Mukhiya of Parswar Panchayat.  Apart from these, nominations have also been filed by many other candidates. With the letter filed now, the caste certificate issued by the district administration has been filed by them and no certificate or information of being a resident of Chhattisgarh has been filed by her.  According to information her nomination papers have been declared valid by the returning officer, while the nomination papers of three other women ST candidates were rejected stating that their native place is Chhattisgarh, so they cannot be given the benefit of reservation for any post in Jharkhand because of scheduled Tribes' seat.

Sunita Devi whose nomination paper has been rejected said that we are poor and weak, so our nomination paper was rejected while LalitaBakhala native place is also in Jashpur, Chhattisgarh but her nomination paper was not rejected.

When contacted, the Returning Officer, Deepak Minj, did not say anything clearly in this regard over the phone, he only said that the nomination papers of two people have been rejected in Paraswar Panchayat.  The reason for rejecting the nomination papers of those people was asked, but he refused to tell them also and was asked to find out from the media cell. "If you want to get information from me then file an RTI," he said.  When asked about LalitaBakhala's case, he kept quiet.

The connection could not be established over the phone with the District Election Officer cum Deputy Commissioner Garhwa, a message has been left on his WhatsApp but no information has been provided from his side so far.

By sending letter number 235 dated 10.1.1.2019 by Deepak Kumar Sinha, Under Secretary, Department of Personnel, Administrative Reforms, Official Language, Government of Jharkhand, to all the Under Chief Secretaries, Principal Secretaries, all Heads of Departments, all Divisional Commissioners, all Deputy Commissioners, it was said that by the Supreme Court the Civil  Appeal No. 8425 22 2013 In the case of RanjanaKumari Vs. State of Uttarakhand and others.

The judgement has been passed on 1.11.2018 in the light of that order, the benefit of reservation is not admissible to the women migrants from other states on the basis of marriage in Jharkhand state.
