Executive Chairman of Jharkhand State legal Services Authority (JHAlSA) Justice D N Patel said that the Mediation as a tool for alternative dispute resolution has been successful in settling various commercial disputes in the State.
He pointed out that that the company cases are not settled anywhere in the country through mediation, but here in Jharkhand, most of the company petitions referred by the court for mediation have been settled.
He was speaking at the inaugural session of a 20-hour capsule training cum refresher programme organised for the mediators at ‘Nyaya Sadan’ where they are being given tips for an effective mediation.
“Now importance of mediation is known to everyone as both the parties go home happily after mediation and there is no chance of further appeal from any of the parties. Otherwise, in most of the cases the dispute continues as both the parties go appealing to the higher courts even after judgment is delivered by a court,” said Justice Patel. Dispute mechanism, under Section 89 of the Civil Procedure, is being legalized out of which one is mediation,” he said
Successful mediators coming from different districts of Jharkhand were given tips on effective communication skills which would help them further in effective mediation between the parties.
“Current training programme is about mediation where success rate has reached up to 75 per cent, which is top in the country. The Supreme Court has chosen 10 mediation centres to develop them on the lines of Delhi Mediation Centre, out of which two are from Jharkhand — one in Ranchi and the other one is of Jamshedpur,” said Justice Patel.
Patel further said that there were special mediators in Jharkhand, who are neither advocates nor Judges; they are retired IAS, IPS, doctors, businessmen and even a former Chief Secretary of the State who have been given special training by the Supreme Court.
