Adding more feathers to its cap, Ranchi Mediation Centre succeeded in resolving altogether 15 cases filed consecutively against each other by two parties since 2007. The matter was referred to Advocate lK Giri for mediation on the directions of Principal Judicial Commissioner AV Singh.
“Matter was related to the war of supremacy between the members of two camps of Maharshi Nikhilesh Seva Sansthan Ranchi where the two parties filed as many as 15 cases against each other in the last nine years which are still pending in different courts of Ranchi,” said advocate Giri. The matter was settled on the conditions that Jyoti Swaroop will remain Chairperson of the organization while Satyendra Prajapati, Ranbir Singh and Rajesh Kumar Verma will not interfere in carrying out his duties, added Giri.
“In the mean time, the two parties will withdraw all the cases filed against each other within 45 days as per the provisions of the law. The two parties also agreed to withdraw other cases also which might have not been put into the notice of the court,” Giri said.
The matter relates to an anticipatory bail application (ABP), filed by Satyendra Prajapati and others which was referred to Ranchi Mediation Centre appointing Giri as mediator on February 9, 2016.
“The matter was finally settled between the two parties on March 16 after a total of nine sittings during which both the parties were also persuaded separately so that they could open up before us and the matter could be resolved. Advocates from both the sides – Rohit Ranjan Prasad and Avinash Pandey-also co-operated and making all efforts in convincing their clients that it was beneficial for them to settle the matter,” said Giri.
According to the advocate, both the parties agreed to shed their ego and sacrifice their rights to get the matter resolved.
Ranchi Mediation Centre, currently having 6 mediators and one conciliator, intends to take its success rate up to 60-65 per cent against the current rate of 58 per cent which itself is the highest in the state.
“In order to make it more effective, a panel of 20 eminent lawyers, doctors, engineers, journalists, retired police officers and bureaucrats has been formed providing them five-day training so that they could be roped in to resolve more and more cases,” said DlSA Secretary RK Pathak. At the mediation centre, people are given an opportunity to open up before the experts so that the basic reason behind the case could be reached out, Pathak added.
“Once the basic reasons behind the cases are known it becomes easier to convince both parties to reach to a consensus and settle the matter after shedding their individual ego,” he added.
