Ruling party in the State, Jharkhand Mukti Morcha (JMM) on Monday expressed gratitude to Supreme Court of India (SC) for its verdict related to mining lease allocation case and at the same time the party also attacked Bharatiya Janata Party (BJP) for allegedly toppling the State Government by misusing the Central Agencies in the State.
Addressing a press meet at the party headquarters in the State Capital, JMM General Secretary, Supriyo Bhattacharya said that the SC has given its verdict in the PIL related to the mining lease allocation case. “Jharkhand Government led by Chief Minister, Hemant Soren has got a big victory in the SC. The court has declared the petition of Shiv Shankar Sharma not maintainable. On June 3, 2022, the Jharkhand High Court had declared the petition of Sharma to be maintainable, after which Hemant Sarkar filed a petition in the SC. The SC said its decision that the PIL is not maintainable and directed the HC to stop hearing of the case. The decision is very important for the elected Government of the State and everything is clear now that the opposition parties are interested in toppling the Government by misusing the Central Agencies,” he added.
Bhattacharya further said that it is the Country of Baba Saheb Bhimrao Ambedkar and no one can go beyond law made by him; the Constitution of India is supreme authority in the Country.
The Party General Secretary further said that on October 27, Governor Ramesh Bais had given a statement in Raipur that he has asked the Election Commission for a second opinion on the issue. The Governor had said that he has again sought the opinion of the Election Commission of India in the above matter, but now it is learned that Vaibhav Tomar, the Chief Minister's lawyer, has written a letter to the Commission again and said that the copy of the second intention was not provided to the Governor. Along with this, Vaibhav Tomar has written a letter to the Election Commission demanding to provide a copy of the second opinion letter sought by the Governor,” he added.
Bhattacharya said that a copy of the letter of the second intention has been sought again on October 31, 2022 in Case 3(G)/2022 case on behalf of Governor Ramesh Bais. “The lawyer has also written in the letter that his client has not received any information about this from the Election Commission. Also the Election Commission is an independent institution. Therefore, he should first be heard in an impartial manner, after that the Governor should be given an opinion on the second point. Tomar sent a letter to the Secretary, Election Commission of India in case 3(G)/2022 on September 15, 2022 to make available the copy of the intention sent by the commission to the Governor of Jharkhand at the earliest. But the commission refused to give the copy,” he added.
