Putting a stay on arrest warrant against Mandar MlA Bandhu in a DA case, the Jharkhand High Court on Friday asked CBI to file an affidavit in the court. Despite a closure report being filed by the CBI, the special CBI court taking cognisance into the matter, had issued warrant against Tirky after he failed to appear before the CBI court.

“The court of Justice RR Prasad on Friday put a stay on the arrest of warrant issued against the Mandar MlA by the CBI court till further hearing,” said his Advocate Vinay Prakash. The Court has also asked the CBI to submit documents which were not submitted in support of the closure report at the time of filing it, said Prakash.

Tirkey had moved to the Jharkhand High Court and filed a quashing petition challenging the cognisance taken against him by the CBI court on August 1. The CBI court taking cognisance in the disproportionate of assets (DA) case filed against Tirkey, had asked him to appear before the court on August 12.

Notably Bandhu, an independent MlA from Mandar Assembly constituency had been demanding a cabinet birth in the JMM headed newly formed Hemant Soren government. The Summon was issued after the CBI had already filed a final closure report in the court on May 21 this year.

The DA case was lodged against Bandhu and his other former cabinet colleagues- Kamlesh Kumar Singh, Bhanu Pratap Shahi, Harinarayan Roi, Enosh Ekka along with the former Chief Minister Madhu Koda followed by a PIl filed by one Durga Oraon before the Jharkhand high. He had raised the matter highlighting therein as to how several ministers in the state owned huge properties in excess to their known sources of income. The next date of hearing is on October 18th.
