High Court rejects Anurag Gupta’s plea

The Jharkhand High Court on Friday rejected plea of Additional Director General (ADG) of Police, Anurag Gupta, who challenged the order of Election Commission of India asking him to stay away of the State during general elections.

Gupta had filed a plea, in which he challenged the recommendation of Election Commission of India (ECI) in which the commission said to keep Gupta outside from the State. However, ECI had said before HC that if Gupta gives a written application then the commission can consider over it.

The ECI had ordered on April 1, transfer of Anurag Gupta from the State. The election commission in its order addressed to the Chief Electoral Officer of Jharkhand had said that IPS Anurag Gupta shall be barred from the present assignment immediately.

The ECI had directed Gupta to report to the resident commissioner Jharkhand, New Delhi on April 2. The poll panel had also made it clear that he should not be allowed any leave and given duty, which prevents his visit to Jharkhand till the completion of the election process.

A first information report was filed on March 29, 2018 against Gupta under section 171 (B) (E), 171 (C) (F) of Indian Penal Code in matter concerning interference in election, misuse of official position, breach of conduct or services rules. Disciplinary proceedings have also been initiated against him.
